It looks like Baron's time will come....

I emailed him earlier today... but it looks like it's about 3:00am where he's currently at, so hopefully I'll get a response tomorrow.

I haven't heard back from him yet; however, looking through his posts (and with a bit of judicious google translate) it appears that he's had a few problems getting the master mold built. Which is probably why he hasn't emailed back yet.

This was actually in the US and the legal argument was not over whether Chapterhouse used copyrighted/trademarked material, it was about whether or not it was possible to copyright/trademark certain things in the first place. GW was claiming protection for various supposedly copyrighted names and concepts but the court determined that either it was not possible to copyright something that was effectively common place (ie the term Space Marine) or that the product they were claiming protection on was in itself derived from other sources and not an original concept.

GW did win on a number of the issues but they lost on considerably more and many believe that this is why they are now changing the names of various units (Tempestus Scions) and codexes (Astra Militarum) so that they are deemed to be original and therefore copyrightable.

I wonder whether a term like "storm army" or "star army", though written in (sloppy, google translate) Latin is actually copyrightable.

On topic: baron going away would please a lot of mon-keigh tournament players

Has anyone OUTSIDE of Russia ordered this model and actually received it? I've heard some horror stories about ordering such primo resin models before, and I'd love to get some positive feedback before I look at picking this guy up...

I don't like to condone 'fake' models or recasts but that is amazing!

I don't think they have a case on that front.

In fact, I thought that was how GW lost most of their cases against Chapterhouse Studios - you can't copyright models you haven't actually made.

(I believe drawing and naming the Miotic Spore didn't give GW any rights regarding CHS making a model of one). Something along those lines, anyway.
